The corruption that is being uncovered at USAID is truly historic. USAID has a budget that is larger than the CIA and the State Department combined, and much of that money was funding a vast network of liberal activists and liberal causes all over the globe. When Laura Ingraham of Fox News asked U.S. Senator Josh Hawley about this, Hawley explained that Democrats “are just losing their minds” because “liberal supply chains” are being cut off… (ref)
We conservatives are losing our minds, too. We’re tripping out on headlines and news which were conspiracy theories only a few weeks ago!
In light of President Trump’s lightning strikes and thunderous results, how could further blog posts in this CD series be of interest? After all, the DOJ Civil Rights Division has been ordered not to file any new complaints, motions to intervene, agreed-upon remands, amicus briefs, or statements of interest.
And, all DOJ CDs signed in the last 90 days will be under review, just as Judge Beaton predicted.
So, why has this post arrived in your email? Because— it is not yet time to stand down! There is much at stake.
Local activists are now demanding that Louisville Metro create its own CD. Why? They are afraid that Judge Beaton will not approve the DOJ CD. ABC reports.
The Courier-Journal, our lazy Louisville sentinel, has published an Opinion from an American Disabilities Act (ADA) employee: Civil rights and disability rights are connected. Read more about her on Bellarmine U’s website. That Opinion is building public support for the Louisville CD though the author does not mention it. It’s all about the ‘underserved’.
Is there anyone in this country who is NOT ‘underserved’? Maybe the TAXPAYERS? The police?
The ADA is now front and center in the CD court docket
A brief review of the progress of the CD since ‘the parties’ reached agreement tells the story:
12-12-24 - The USA (DOJ) files the lawsuit and proposed decree, believing the Judge will sign without scrutiny. The Defendant, Louisville Metro (Louisville Jefferson Co. Metro Government), agrees with it.
12-27-24 - River City FOP (police union) files a motion to intervene because its Collective Bargaining Agreement is being violated.
12-28-24 - Judge Beaton files an Opinion and Order setting a Hearing date of January 13 for this case.
1-13-25 - The hearing begins in the Western District Courthouse. It’s lengthy and includes attorney teams and three Amicis:
1) The Heritage Foundation, 2) ACLU-KY, and 3) Lindsey Simmons, an attorney representative for many Amici associated with the Bazelon Center for Mental Health Law or that strongly support the ADA. Bazelon is notable for effective legal defense of the ADA.
Judge Beaton instructs the parties to supplement their papers by the end of the week.
1-14-25 - BAM! Numerous briefs are filed to add Amici.
1-18-25 - Judge Beaton files an Order—
In response to the proposed agreement, this Court must comply with the law and exercise reasoned discretion in determining whether the proposed consent decree is a fair, adequate, and reasonable response to the Police Department’s alleged violations that would serve the public interest. To make that determination, the Court now orders—rather than invites—the parties to address (within a month) the questions initially raised during its hearing earlier this week. The public’s interest in the transparent, accountable, and durable reforms the Government has promised should mean the parties have little reason to avoid sharing this and related information…. 1-31-25 - Docket for the case has fattened to 32 Amici. All but one are concerned to show support for the ADA to show solidarity with the CD’s seventh ‘finding’— Louisville Metro and LMPD Violate the Americans with Disabilities Act in their Response to People with Behavioral Health Disabilities. They agree with the other six findings as well.
2-6-25 - Magistrate Judge officially adds numerous attorneys who were not initially eligible (had not filed forms nor paid fee to practice before the Bar of the Court).
2-7-25 - C-J publishes Opinion by ADA spokesperson.
The Amici (Friends of the Court) who want to instruct the Judge on the critical importance of the ADA and obeying all its regulations, are lined up behind the DOJ:
5 ADA-related doctors or professionals
12 ADA-related organizations, including the Center for Policy Equity, St. John Center, Louisville Coalition for the Homeless, Wellspring, Ky Mental Health Coalition, and seven similar
14 ADA and similar Amici of the ACLU-KY, including the Fairness Campaign, the 490 Project, Dove Delegates, Families United, Forward Justice Action Network, Interfaith Coalition for Immigrant Justice, and another eight
9 Bazelon attorneys
2 ACLU attorneys
Total: 11 attorneys for 31 Amici individuals and organizations.
Plus: 9 DOJ attorneys, 5 Louisville Metro attorneys who are committed to show complete support for the CD, and the 2 or more for the FOP.
We conservatives and police have one Amici, The Heritage Foundation (HF) represented by four attorneys, two from Louisville. The HF included The Law Enforcement Legal Defense Fund (LEDLF) in its Brief. More about their contributions will be covered in a future post. Even if the CD is cancelled by the new DOJ, Mayor Greenberg has promised to implement all DOJ reforms.
Louisvillians, it’s time to get up to speed on the goals and work of the ADA and of the activists who are demanding a CD to control our police. Whether it be a national or local decree, police protection for citizens will decrease. Write the Mayor a letter. Please share this post!
They have brought out the big guns using just another tool to eviscerate what is left of LMPD. Seem little we can do locally to kill this and even if it is killed Greenberg has promised enforce it any way. So it matters little to him what is right and all that matters is pressure from not only local but nationwide activists. Now the legislature is trying to give the Dems cover with non partisan elections. This must be revoked before the next election.
